(CCS: solidarity and urban renewal, Act N ° 2000-1208 of 13.12.2000)


If the preliminary contract concerns a building intended for housing for a "non professional" buyer, the SRU LAW allows for a 7 days delay for withdrawal, starting from the day after receipt of the letter giving notification of the deed of sale. Withdrawal is to be indicated by registered mail with acknowledgement of receipt  (art.271-1 of the new Code of Construction and Housing)
 

Any valid withdrawal is definitive even if the 7 days are not over and should there be several buyers the withdrawal of one buyer will cancel all other intentions.
This law determines the payment to the receiver depositary : if the buyer decides to abandon the present preliminary contract during the withdrawal period, the receiver is obliged to pay back the deposit within 21 days starting from the date of that withdrawal. Any dispute among parties is to be settled in the appropriate court of justice
