LEASE CONTRACT

The lease is a contract which clarifies the rights and obligations between tenant and owner, called the lessor. According to the law of 06 th July 1989, a lease contract must be signed by both parties in duplicate.

According to the law of 06 th July 1989, a lease contract is signed for a minimum of 3 years (when the lessor is a physique person) and 6 years when the lessor is a company.

  • Compulsory mentions:

the lease contract must absolutely contain the following information:

- owner name, address (or his agent: estate agency).

- rental period: signature date, date of the first entry.

- Apartment: number of rooms, description, common parts mentioned.

- Rent income: amount, payment terms, review requirements.

- deposit.

  • Documents to include in the lease contract: some documents must be attached to the lease contract

- the inventory.

- extract of the condominium rules.

- certificate of insurance against rental risks of the residence.

- A description of the intermediaries remuneration (eg: real estate agency) as these costs are shared aqually between the tenant and the owner.

- the bond of another, if necessary (it is preferable that such commitment is part of the lease).

- technical diagnostics.

DIAGNOSTICS REQUIRED

For rental, some diagnotics are required for lessor, regardless of the nature of the leased property: thus the ECD ( since 1st July 2007), exposure to lead (from august 12, 2008) and finally the state natural and technological risks (since 1 june 2006). The technical dossier is in this case attached to the lease.

The energy report:

It evaluates the energy consumption of housing and, through technical guidance, achieve energy savings. It is valid for 10 years.

Law grenelle 2 of July 12, 2010 makes it compulsory from 1st january 2011. The display of ranking energy in all real estate and rental agency, regardless of the allocation of the property.

Diagnostics lead:
